ASLmods – Online Returns & Refunds Policy

1. Application

This Online Returns & Refunds Policy applies to Goods purchased directly from ASLmods through:

  • the ASLmods online store;
  • telephone or email orders;
  • an ASLmods Quote for the supply of Goods; or
  • another direct remote sale of Goods by ASLmods.

This Policy applies to Goods only.

Workshop bookings, engine-conversion deposits and Workshop Services are governed separately by the ASLmods Workshop Cancellation, Deposits & Refunds Policy and other applicable Workshop policies.

This Policy should be read together with the:

  • ASLmods Online Store Terms & Conditions;
  • ASLmods Online Product Warranty Policy;
  • applicable Quote;
  • applicable invoice; and
  • applicable Order documentation.

Nothing in this Policy excludes, restricts or modifies any right or remedy available under the Australian Consumer Law (ACL) that cannot lawfully be excluded, restricted or modified.


2. Australian Consumer Law

Goods sold by ASLmods come with consumer guarantees that cannot be excluded under the Australian Consumer Law where the ACL applies.

Depending on the circumstances, Goods must:

  • be of acceptable quality;
  • be fit for any disclosed purpose;
  • match their description;
  • match any sample or demonstration model where applicable;
  • have clear title; and
  • otherwise comply with applicable consumer guarantees.

If Goods fail to comply with an applicable consumer guarantee, the Customer may be entitled to a repair, replacement, refund, compensation or other remedy depending on the circumstances and whether the failure is major or minor.

ASLmods' voluntary return rules in this Policy operate in addition to those rights.


3. Change of Mind

ASLmods does not provide refunds, exchanges or credits merely because the Customer:

  • changes their mind;
  • no longer requires the Goods;
  • finds the Goods cheaper elsewhere;
  • purchases or selects the wrong product;
  • changes their Vehicle or project;
  • sells or intends to sell their Vehicle;
  • decides not to proceed with a planned modification; or
  • otherwise no longer wants the Goods.

ASLmods may, at its discretion, agree to accept otherwise eligible Goods for return despite not being legally required to do so.

Where ASLmods agrees to such a return, the conditions and charges contained in this Policy apply.


4. Customer Responsibility for Product Selection

The Customer is responsible for providing ASLmods with accurate information concerning their requirements and intended application.

This may include:

  • Vehicle make and model;
  • year;
  • engine;
  • transmission;
  • drivetrain;
  • existing modifications;
  • intended engine conversion;
  • turbocharger configuration;
  • measurements;
  • specifications; and
  • other information relevant to product compatibility.

Where the Customer selects Goods without relying on specific fitment advice from ASLmods, the Customer is responsible for ensuring the selected Goods are appropriate for their intended application.

Nothing in this section limits any consumer guarantee where the Customer made a particular purpose known to ASLmods and relied upon ASLmods' skill or judgment in selecting suitable Goods.


5. Incorrect Information Provided by the Customer

ASLmods is not responsible for Goods being unsuitable because the Customer supplied materially incorrect, incomplete or misleading Vehicle, application or specification information, except to the extent required by law.

Where ASLmods agrees to accept Goods back in these circumstances, the return may be treated as a discretionary return and may be subject to the 20% restocking fee, applicable freight costs and other permitted deductions described in this Policy.


6. Return Requests

Before returning Goods, the Customer must contact ASLmods and obtain return instructions.

ASLmods may require the Customer to complete a return or warranty form and provide:

  • Customer name;
  • Order or invoice number;
  • proof of purchase;
  • product details;
  • reason for return;
  • Vehicle details where relevant;
  • photographs;
  • details of any alleged fault; and
  • other information reasonably required to assess the request.

Goods should not be returned without first contacting ASLmods.


7. Timeframe for Discretionary Returns

Where ASLmods agrees to accept a return that is not required under the Australian Consumer Law, the Customer must contact ASLmods within 7 days of delivery unless ASLmods agrees otherwise in writing.

Approval of a return request does not itself mean that ASLmods has accepted that the Goods are faulty or that a refund is payable.

The Goods remain subject to inspection after return.

The 7-day period does not apply to a claim under the Australian Consumer Law and does not reduce or limit any statutory rights.


8. Condition of Discretionary Returns

Unless ASLmods agrees otherwise, Goods accepted as a discretionary return must:

  • be unused;
  • not have been installed;
  • not have been fitted or test-fitted in a way that marks or damages them;
  • not have been modified;
  • not have been painted or coated;
  • not have been programmed or configured specifically for the Customer;
  • be clean;
  • be undamaged;
  • be complete;
  • include all components, hardware, instructions and accessories originally supplied;
  • be in a condition suitable for resale as new; and
  • where reasonably applicable, be returned in the original packaging.

ASLmods may refuse a discretionary return where these requirements are not met.

These conditions do not restrict remedies available for faulty or non-compliant Goods under the Australian Consumer Law.


9. 20% Restocking Fee

Where ASLmods agrees to accept a return and the return is not caused by an error, breach or failure by ASLmods, a 20% restocking fee may be deducted from the amount otherwise credited or refunded.

The restocking fee may apply where:

  • the Customer ordered or selected the incorrect product;
  • the Customer provided incorrect Vehicle or specification information;
  • the Customer no longer requires the Goods;
  • the Customer changes their mind;
  • ASLmods voluntarily agrees to accept an otherwise non-returnable product; or
  • another return is accepted at ASLmods' discretion.

The 20% restocking fee will not be charged where the Customer is entitled to a remedy under the Australian Consumer Law because ASLmods supplied faulty, incorrect or otherwise non-compliant Goods.


10. Packaging

Customers should retain original packaging until they are satisfied that the Goods supplied are correct and suitable.

Where ASLmods accepts a discretionary return and:

  • original packaging is missing;
  • packaging has been materially damaged;
  • specialised packaging must be replaced; or
  • the Goods require repackaging before resale,

ASLmods may deduct the reasonable cost of replacement packaging or repackaging from the refund or credit.

This does not apply where doing so would unlawfully reduce or interfere with a Customer's remedy under the Australian Consumer Law.


11. Return Freight – Discretionary Returns

Where a return is accepted at ASLmods' discretion and is not caused by ASLmods, the Customer is responsible for:

  • return freight;
  • appropriate packaging;
  • freight insurance where desired; and
  • risk of loss or damage while the Goods are being returned.

ASLmods recommends using a traceable freight or delivery service.

Original outbound freight and any additional freight costs reasonably incurred by ASLmods may be deducted from the amount refunded where permitted by law and applicable to the discretionary return.


12. Incorrect Goods Supplied by ASLmods

Where ASLmods supplies Goods that are materially different from those ordered because of an ASLmods error, the Customer should contact ASLmods as soon as reasonably practicable.

ASLmods may arrange:

  • return of the incorrect Goods;
  • supply of the correct Goods;
  • replacement;
  • refund; or
  • another appropriate remedy.

The Customer will not be charged a restocking fee for a return caused by ASLmods supplying incorrect Goods.

ASLmods will bear reasonable return costs where required by law or otherwise agreed with the Customer.


13. Faulty Goods

Where the Customer believes Goods are faulty, defective or otherwise fail to comply with an applicable consumer guarantee, the Customer should contact ASLmods and provide reasonable details of the issue.

ASLmods may request:

  • photographs;
  • videos;
  • diagnostic information;
  • installation information;
  • Vehicle details;
  • maintenance information;
  • installer details; and
  • other information reasonably relevant to assessing the claim.

ASLmods may inspect, test or arrange assessment of the Goods before determining the appropriate remedy.

Warranty claims will also be dealt with in accordance with the ASLmods Online Product Warranty Policy.


14. Major Failure

Where Goods have a major failure under the Australian Consumer Law, the Customer may be entitled to choose between:

  • rejecting the Goods and obtaining a refund; or
  • rejecting the Goods and obtaining replacement Goods of the same type and similar value,

subject to the Australian Consumer Law.

The Customer may also have rights to compensation for reasonably foreseeable loss or damage resulting from the failure.


15. Minor Failure

Where a failure is not major, ASLmods may generally choose to:

  • repair the Goods;
  • replace the Goods; or
  • provide another remedy permitted by the Australian Consumer Law,

within a reasonable time.

If ASLmods fails to remedy a minor failure within a reasonable time, further rights may become available to the Customer under the Australian Consumer Law.


16. Inspection and Testing

ASLmods may reasonably inspect, test or arrange assessment of returned Goods to determine:

  • whether a fault exists;
  • the nature and cause of the fault;
  • whether the Goods have been incorrectly installed;
  • whether the Goods have been modified;
  • whether misuse or external damage occurred;
  • whether the Goods have been used outside their intended specifications; and
  • what remedy is appropriate.

Where Goods are found to have a problem covered by the Australian Consumer Law or an applicable ASLmods warranty, ASLmods will provide the appropriate remedy.


17. No Fault Found

If inspection reasonably establishes that the Goods are not faulty and do not otherwise fail to comply with an applicable consumer guarantee or voluntary warranty, ASLmods may decline the warranty or return claim.

Where disclosed to the Customer before the relevant costs are incurred, ASLmods may charge reasonable costs associated with:

  • testing;
  • diagnosis;
  • assessment; and
  • return freight

where no covered fault is found.


18. Incorrect Installation

ASLmods is not responsible for defective installation or workmanship performed by a Customer or third party.

A voluntary return or warranty claim may be declined where the claimed damage or failure was caused by:

  • incorrect installation;
  • incorrect assembly;
  • incorrect adjustment;
  • incorrect torque;
  • incorrect wiring;
  • incorrect programming;
  • failure to follow applicable instructions;
  • use of incompatible components;
  • incorrect fasteners;
  • incorrect fluids or lubricants; or
  • other Customer or third-party workmanship.

Incorrect installation does not automatically remove rights relating to an inherent defect in the Goods that was not caused by the installation.


19. Installed Goods

Goods that have been installed, used or modified are generally not eligible for a discretionary change-of-mind return.

This does not prevent a Customer from making a claim where installed Goods are faulty or otherwise fail to comply with an applicable consumer guarantee.

Where the condition of the Goods is relevant to determining the cause of a claimed fault, ASLmods may inspect the Goods before determining the appropriate remedy.


20. Modified Goods

ASLmods may decline a voluntary return or voluntary warranty claim where Goods have been:

  • cut;
  • drilled;
  • welded;
  • machined;
  • ground;
  • bent;
  • painted;
  • coated;
  • programmed;
  • dismantled;
  • altered; or
  • otherwise modified

and the modification prevents resale or caused or contributed to the claimed failure.

Nothing in this section removes statutory rights relating to a defect which was not caused or contributed to by the modification.


21. Custom, Made-to-Order and Special-Order Goods

ASLmods does not ordinarily accept discretionary returns or cancellations for Goods which have been:

  • custom manufactured;
  • made-to-order;
  • specially ordered;
  • fabricated;
  • machined;
  • modified;
  • painted;
  • powder coated;
  • colour coded;
  • programmed;
  • configured;
  • specially imported; or
  • otherwise produced or procured specifically for the Customer.

This applies where production, procurement, customisation or modification has commenced.

This exclusion applies to change-of-mind and discretionary returns only.

It does not remove the Customer's rights where the Goods fail to comply with the Australian Consumer Law.


22. Cancellation Before Dispatch

Customers should contact ASLmods as soon as possible if they wish to cancel an Order.

Where an Order has not been dispatched, ASLmods may agree to cancellation subject to:

  • whether processing has commenced;
  • whether Goods have been specially ordered;
  • whether fabrication or customisation has commenced;
  • supplier cancellation charges;
  • freight already incurred;
  • administrative costs reasonably incurred specifically for the Order; and
  • other reasonable costs associated with the Order.

A cancellation requested by the Customer is not accepted until confirmed by ASLmods.

Nothing in this section limits a statutory right to cancel or obtain a refund where such a right exists.


23. Cancellation After Dispatch

Once Goods have been dispatched, an Order cannot ordinarily be cancelled before delivery.

If ASLmods agrees to accept the Goods back after delivery, the return will be dealt with in accordance with the applicable provisions of this Policy.

This does not affect any statutory cancellation, rejection or refund rights.


24. Purchases Through Distributors or Resellers

Where Goods were purchased from an independent ASLmods distributor, reseller or other retailer rather than directly from ASLmods, the Customer should ordinarily contact the business that sold the Goods in the first instance.

That seller remains responsible for its obligations to the Customer under the Australian Consumer Law.

ASLmods may assist with manufacturer or product warranty assessment where appropriate.


25. Proof of Purchase

ASLmods may require reasonable proof that Goods were purchased from ASLmods before processing a return, refund, replacement or warranty claim.

Acceptable proof may include:

  • an ASLmods invoice;
  • receipt;
  • Order confirmation;
  • Order number;
  • bank statement;
  • card statement;
  • payment record; or
  • other reasonable evidence demonstrating the purchase.

The original tax invoice is preferred but is not the only acceptable form of proof of purchase.


26. Returning Goods to ASLmods

Once authorised by ASLmods, Goods should be returned to:

The Customer should include or provide:

  • their name;
  • contact details;
  • Order or invoice number;
  • return authorisation or completed form where requested; and
  • details of the reason for return.

Customers must package Goods appropriately to reduce the risk of loss or damage during transport.


27. Risk During Return Freight

For discretionary Customer-funded returns, the Customer bears the risk of loss or damage during return transport until the Goods are received by ASLmods, subject to applicable law.

ASLmods recommends:

  • traceable freight;
  • appropriate protective packaging; and
  • freight insurance for high-value Goods.

Where ASLmods arranges or is legally responsible for return freight, responsibility will be determined according to the applicable circumstances and law.


28. Refunds

Where a refund is approved, ASLmods will ordinarily issue the refund using the original payment method where reasonably practicable.

For discretionary returns, the amount refunded may be reduced by permitted:

  • restocking fees;
  • original freight;
  • return freight;
  • replacement packaging costs; and
  • other agreed or reasonably applicable costs.

No deduction will be made where doing so would unlawfully reduce or interfere with a remedy the Customer is entitled to under the Australian Consumer Law.


29. Exchanges and Store Credit

Where ASLmods accepts a discretionary return, ASLmods may agree with the Customer to provide:

  • an exchange;
  • replacement Goods;
  • store credit; or
  • a refund.

A Customer will not be required to accept store credit where they are legally entitled to a monetary refund under the Australian Consumer Law.


30. Refund Processing

Once a refund has been approved and processed by ASLmods, the time taken for funds to appear in the Customer's account may depend on the Customer's:

  • bank;
  • card issuer;
  • payment provider; or
  • other financial institution.

ASLmods is not responsible for processing delays caused solely by an independent payment provider after ASLmods has issued the refund.


31. Additional Loss or Damage

Where Goods fail to comply with an applicable consumer guarantee, the Customer may also have a right to compensation for reasonably foreseeable loss or damage caused by the failure.

Nothing in this Policy excludes or restricts such a right where it exists under the Australian Consumer Law.


32. Relationship With the Online Product Warranty Policy

This Policy deals primarily with:

  • returns;
  • refunds;
  • exchanges;
  • cancellations;
  • return freight;
  • discretionary returns; and
  • return procedures.

The ASLmods Online Product Warranty Policy separately deals with:

  • ASLmods voluntary product warranties;
  • warranty periods;
  • product defects;
  • third-party manufacturer warranties;
  • warranty exclusions;
  • warranty assessment; and
  • warranty claim procedures.

The two policies should be read together.


33. Electronic Communications and Return Authorisation

Return, cancellation, refund and exchange communications may occur through:

  • email;
  • telephone;
  • SMS;
  • electronic messaging;
  • website forms;
  • electronic Order systems; or
  • another communication method accepted by ASLmods.

ASLmods may rely upon electronic communications and business records as evidence of:

  • a return request;
  • return approval;
  • cancellation;
  • Customer instructions;
  • refund agreement; or
  • other relevant authorisation,

to the extent permitted by law.


34. Changes to this Policy

ASLmods may amend this Online Returns & Refunds Policy from time to time.

Unless otherwise agreed or required by law, amendments will apply to Orders entered into after the amended Policy takes effect and will not retrospectively alter an existing Order.

The current version of this Policy will be made available through the ASLmods website.
