ASLmods – Online Product Warranty Policy

Australian Consumer Law Notice

Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.

This Online Product Warranty Policy is provided in addition to, and does not limit, restrict or replace any rights or remedies available under the Australian Consumer Law.


1. Application

1.1 Online Goods

This Online Product Warranty Policy applies to Goods purchased directly from ASLmods through:

  • the ASLmods online store;
  • telephone or email orders;
  • an ASLmods Quote for the supply of Goods; or
  • another direct sale of Goods where ASLmods does not perform the installation as a Workshop Service.

This Policy applies to Goods only.

Goods supplied and installed by ASLmods as part of Workshop Services are governed by the ASLmods Workshop Warranty Policy.

1.2 Related Documents

This Policy should be read together with the:

  • ASLmods Online Store Terms & Conditions;
  • ASLmods Online Returns & Refunds Policy;
  • applicable Quote;
  • applicable invoice;
  • applicable Order documentation; and
  • any product-specific warranty information supplied with the Goods.

2. ASLmods Voluntary Product Warranty

2.1 Warranty Period

Unless a different warranty period is expressly stated in this Policy or provided in writing for a particular product, ASLmods warrants that Goods supplied by ASLmods will be free from defects in materials and workmanship for 12 months from the date of purchase.

This is referred to as the Warranty Period.

2.2 What the Warranty Covers

The ASLmods voluntary Product Warranty applies to a defect in the Goods which arises from:

  • defective materials;
  • defective manufacture; or
  • another inherent defect covered by the applicable voluntary warranty.

Warranty coverage depends upon the cause of the alleged failure and the circumstances of the particular claim.

2.3 Remedy

Where ASLmods determines that a defect is covered by its voluntary Product Warranty, ASLmods may, subject to the Customer's rights under the Australian Consumer Law:

  • repair the Goods;
  • replace the Goods;
  • supply equivalent Goods; or
  • provide a refund.

Where the Australian Consumer Law gives the Customer the right to choose a particular remedy, this voluntary warranty does not restrict that right.


3. Major Failures

Where Goods have a major failure under the Australian Consumer Law, the Customer may be entitled to choose between:

  • rejecting the Goods and receiving a refund; or
  • rejecting the Goods and receiving replacement Goods of the same type and similar value,

subject to applicable law.

The Customer may also be entitled to compensation for other reasonably foreseeable loss or damage caused by the failure.


4. Minor Failures

Where a failure does not amount to a major failure, ASLmods may generally choose to provide an appropriate remedy permitted by the Australian Consumer Law, including repair or replacement, within a reasonable time.

If the failure is not remedied within a reasonable time, further rights may become available to the Customer under the Australian Consumer Law.


5. Ownership of Replaced or Refunded Goods

Where ASLmods:

  • replaces Goods under this voluntary warranty; or
  • provides a full refund for returned Goods,

the replaced or refunded Goods become the property of ASLmods, subject to applicable law.

ASLmods may retain, inspect, dispose of or return those Goods to the relevant manufacturer, supplier or distributor.


6. Third-Party Manufacturer Warranties

6.1 Goods Not Manufactured by ASLmods

Where Goods are manufactured by a third party, the Goods may also be covered by a manufacturer's warranty.

The length and conditions of a manufacturer's warranty may differ from the ASLmods voluntary Product Warranty.

6.2 Manufacturer Assessment

ASLmods may:

  • inspect the Goods;
  • return the Goods to the manufacturer, supplier or Australian distributor;
  • provide photographs or technical information;
  • obtain a technical assessment; or
  • otherwise liaise with the manufacturer in relation to the claimed defect.

6.3 Customer Rights Against ASLmods

A manufacturer's warranty does not replace any rights the Customer may have against ASLmods under the Australian Consumer Law.

The Customer is not required to rely solely on the manufacturer in order to exercise statutory rights against ASLmods.


7. Inspection and Assessment

ASLmods may reasonably inspect, test or arrange assessment of Goods before determining whether a claimed fault is covered.

Assessment may consider:

  • the nature of the alleged defect;
  • installation;
  • Vehicle configuration;
  • modifications;
  • compatibility;
  • evidence of impact or damage;
  • wear;
  • maintenance;
  • operating conditions;
  • lubrication;
  • electrical configuration;
  • product specifications; and
  • any other factor reasonably relevant to determining the cause of failure.

Approval to return Goods does not itself constitute acceptance that the Goods are defective or that a warranty remedy is payable.


8. General Voluntary Warranty Exclusions

Subject always to any rights which cannot lawfully be excluded under the Australian Consumer Law, ASLmods' voluntary Product Warranty does not cover a failure or damage caused by:

(a) incorrect installation;

(b) incorrect assembly;

(c) incorrect adjustment;

(d) misuse or abuse;

(e) negligence;

(f) inadequate or incorrect maintenance;

(g) overloading;

(h) failure to lubricate correctly;

(i) under-greasing or over-greasing;

(j) incorrect fluids or lubricants;

(k) use of incompatible components;

(l) operation outside stated mechanical, electrical, temperature, load or environmental specifications;

(m) failure to follow applicable installation instructions, recommendations or specifications;

(n) racing or competition use where the Goods were not expressly supplied for that purpose;

(o) collision, road impact, abrasion or accident damage;

(p) off-road impact or use beyond the Goods' intended operating conditions;

(q) corrosion or environmental damage not caused by an inherent defect;

(r) unauthorised modification or alteration;

(s) welding, grinding, drilling, machining, bending, repainting or coating where that work causes or contributes to the failure;

(t) incorrect electrical connection or programming;

(u) third-party workmanship;

(v) materially incorrect or incomplete information supplied by the Customer; or

(w) another external cause unrelated to an inherent defect in the Goods.

These exclusions apply only to the extent that the relevant circumstance caused or contributed to the claimed failure.


9. Normal Wear and Tear

ASLmods' voluntary Product Warranty does not cover ordinary deterioration resulting from normal use where the Goods are functioning as reasonably expected for their age, use and operating environment.

Components that may naturally wear during use include, depending on the product:

  • bushings;
  • bump stops;
  • ball joints;
  • heim joints;
  • bearings;
  • seals;
  • joints; and
  • other serviceable or wear components.

This does not exclude a claim where premature deterioration itself means the Goods fail an applicable consumer guarantee.


10. Modification of Goods

Modification of Goods does not automatically cancel every warranty or consumer right.

However, ASLmods may decline a claim under its voluntary Product Warranty where the claimed failure was caused or materially contributed to by modification of the Goods.

Modifications may include:

  • welding;
  • cutting;
  • grinding;
  • drilling;
  • machining;
  • bending;
  • repainting;
  • powder coating;
  • attaching additional components;
  • dismantling;
  • reprogramming; or
  • other alteration from the supplied condition.

A modification unrelated to the claimed defect will not, by itself, eliminate statutory rights relating to that defect.


11. Installation by the Customer or a Third Party

11.1 Installer Responsibility

Where Goods are installed by the Customer, mechanic, technician, workshop or another third party, that person is responsible for the quality and correctness of their installation work.

ASLmods does not warrant workmanship performed by a person who is not ASLmods.

11.2 Incorrect Installation

ASLmods may decline a voluntary warranty claim where the Goods failed or were damaged because of:

  • incorrect installation;
  • incorrect assembly;
  • incorrect adjustment;
  • incorrect torque;
  • incorrect wiring;
  • incorrect programming;
  • incompatible associated components;
  • failure to follow specifications or instructions; or
  • other installation or workmanship error.

11.3 Mechanic Installation Does Not Transfer Liability

Installation by a qualified or licensed mechanic does not make ASLmods responsible for that mechanic's workmanship.

Where the mechanic independently:

  • selects;
  • recommends;
  • modifies;
  • installs; or
  • configures

Goods incorrectly, responsibility for that work does not transfer to ASLmods merely because ASLmods supplied the Goods.

11.4 ASLmods Product Advice

Where the Customer or installer made a particular intended purpose known to ASLmods and reasonably relied upon ASLmods to select or recommend suitable Goods, this section does not exclude any applicable consumer guarantee concerning fitness for that disclosed purpose.

11.5 Product Defect Still Covered

Incorrect third-party installation does not itself remove rights relating to an inherent defect in the Goods which was not caused by the installation.


12. Incorrect Product Selection by the Customer

Where the Customer independently selects Goods and the Goods are unsuitable because the Customer:

  • selected the wrong product;
  • provided incorrect Vehicle information;
  • provided incorrect engine or transmission information;
  • failed to disclose relevant modifications; or
  • otherwise ordered Goods unsuitable for their application,

that does not constitute a product defect.

Any discretionary return will be dealt with under the ASLmods Online Returns & Refunds Policy.

Where ASLmods specifically recommended Goods after being told the Customer's particular intended purpose, applicable Australian Consumer Law rights remain unaffected.


13. Subjective Preferences

ASLmods' voluntary Product Warranty does not apply merely because the Customer does not like a subjective characteristic of Goods where the Goods otherwise perform as represented.

Examples may include personal preferences relating to:

  • ride feel;
  • firmness;
  • appearance;
  • sound;
  • perceived ease of installation; or
  • another subjective characteristic.

This does not apply where a characteristic was expressly represented by ASLmods and the Goods fail to correspond with that representation.


14. Finish, Paint and Coating

Cosmetic finish, paint, coating or surface deterioration caused after supply by:

  • installation;
  • tools;
  • abrasion;
  • road debris;
  • environmental exposure;
  • chemicals;
  • cleaning products;
  • impact;
  • corrosion;
  • modification; or
  • ordinary wear

is not covered by the voluntary Product Warranty unless the deterioration results from an inherent defect covered by the warranty.


15. Suspension Springs and Bump Stops

Where suspension springs require specified bump-stop configuration, ASLmods' voluntary Product Warranty does not cover damage caused by use without:

  • appropriate bump stops;
  • correct bump-stop clearance; or
  • other applicable suspension-travel limitation

where those matters caused or materially contributed to the damage.


16. Shock Absorbers and Bump Stops

ASLmods' voluntary Product Warranty does not cover damage to shock absorbers caused by operation without appropriate bump-stop settings or suspension-travel limitation where that configuration caused or materially contributed to the failure.


17. Remote Reservoir Shock Absorbers

Remote reservoir shock absorbers supplied by ASLmods carry a 12-month voluntary warranty against leakage caused by an inherent defect from the date of purchase.

Normal servicing, rebuilding and service replacement parts are not included as warranty items merely because servicing becomes necessary.

Rebuilds and replacement or service components may be available separately.

Nothing in this section limits applicable rights under the Australian Consumer Law.


18. Rubber Bushes

18.1 Bush Types

ASLmods may supply Genuine OE bushes where reasonably available or other bushes selected for the relevant application.

18.2 Voluntary Warranty Period

Unless otherwise stated:

  • Genuine/OE bushes: 3-month voluntary warranty;
  • ASLmods bushes: 6-month voluntary warranty.

18.3 Coverage

The voluntary bush warranty applies to inherent defects in the supplied Goods.

It does not cover deterioration or failure caused by:

  • abuse;
  • over-flexing;
  • incorrect suspension geometry;
  • incorrect installation;
  • binding;
  • excessive travel;
  • contamination;
  • incompatible components; or
  • other external causes.

The above voluntary warranty periods do not limit any consumer-guarantee rights that may continue to apply beyond those periods.


19. Structural Tolerances

Unless ASLmods expressly provides a different written warranty for a particular product:

19.1 Steering Rods

No lifetime voluntary warranty applies to ASLmods steering rods under 10 mm thickness over 1,000 mm length.

19.2 Control Arms

No lifetime voluntary warranty applies to control arms showing bends exceeding 5 mm per 1,000 mm, where the deformation is consistent with external force, overloading, impact or use outside applicable design limits.

Any separate lifetime warranty offered by ASLmods is subject to its stated conditions.

Nothing in this section excludes consumer rights that cannot lawfully be excluded.


20. Racing, Motorsport and High-Stress Use

Unless Goods are expressly represented by ASLmods as suitable for a particular racing, motorsport or competition application, the voluntary Product Warranty does not cover failures caused by:

  • racing;
  • competition;
  • timed events;
  • jumping;
  • extreme impact;
  • operation substantially beyond intended loads; or
  • another high-stress application outside the Goods' intended purpose.

Where ASLmods expressly sells Goods for a disclosed competition or high-performance purpose, warranty assessment will take that disclosed intended purpose into account.


21. Consequential Component Damage

Where a product failure is caused by something for which ASLmods is not responsible, including:

  • incorrect installation;
  • misuse;
  • incompatible components;
  • unauthorised modification;
  • a pre-existing Vehicle fault; or
  • third-party workmanship,

ASLmods is not responsible under its voluntary warranty for resulting damage.

Nothing in this Policy excludes a Customer's entitlement under the Australian Consumer Law to compensation for reasonably foreseeable loss or damage where such an entitlement exists.


22. Labour, Removal and Installation Costs

ASLmods' voluntary Online Product Warranty does not automatically cover third-party costs associated with:

  • diagnosis;
  • removal of Goods;
  • installation;
  • reinstallation;
  • testing;
  • Vehicle downtime; or
  • third-party workshop labour.

Responsibility for such costs will depend on the circumstances of the claim and applicable law.

Nothing in this section excludes a Customer's right to recover reasonably foreseeable loss or expense under the Australian Consumer Law where such a right exists.


23. Warranty Claim Expenses and Freight

23.1 Initial Contact

Customers should contact ASLmods before returning Goods under warranty.

23.2 Return Freight

Responsibility for return freight depends upon the reason for the return and applicable law.

Where a claim is accepted under ASLmods' voluntary Product Warranty, ASLmods will deal with reasonable warranty-related freight as determined for the particular claim.

Where Goods fail to comply with an applicable consumer guarantee, ASLmods will meet or reimburse reasonable return costs where required under the Australian Consumer Law.

23.3 Customer-Paid Freight

Where ASLmods reasonably requests the Customer to initially arrange return freight, the Customer should retain the freight receipt.

If the claim is subsequently accepted and the Customer is entitled to reimbursement, ASLmods will reimburse reasonable applicable freight expenses.

23.4 No Covered Defect

If the Goods are assessed and no covered defect or consumer-guarantee failure is found, the Customer may be responsible for:

  • return freight; and
  • reasonable testing or assessment charges,

provided those charges were disclosed before being incurred.


24. Making a Warranty Claim

To lodge a warranty claim, the Customer should contact:

The Customer should provide:

  • name and contact details;
  • Order or invoice number;
  • reasonable proof of purchase;
  • details of the Goods;
  • Vehicle make, model and configuration where relevant;
  • details of the alleged fault;
  • when the fault first became apparent;
  • photographs or video where reasonably available;
  • installation information;
  • installer details where relevant; and
  • any other information reasonably required to investigate the claim.

ASLmods may provide a Warranty Claim or Return Form for completion.


25. Proof of Purchase

The Customer must provide reasonable evidence that the relevant Goods were purchased from ASLmods.

Proof of purchase may include:

  • an invoice;
  • receipt;
  • Order confirmation;
  • Order number;
  • bank statement;
  • card statement;
  • payment record; or
  • other reasonable evidence of the transaction.

The original tax invoice is preferred but is not the only acceptable form of proof of purchase.


26. Returning Goods for Assessment

Where ASLmods requires the Goods to be physically assessed, approved returns should be sent to:

Goods must be appropriately packaged to reduce the risk of further damage during transport.

The Customer should follow any return instructions provided by ASLmods.


27. Third-Party Repairs or Alterations Before Assessment

Where reasonably practicable, the Customer should give ASLmods a reasonable opportunity to inspect the Goods before arranging:

  • repair;
  • dismantling;
  • modification;
  • disposal; or
  • destructive testing

by another party.

ASLmods may decline reimbursement of unauthorised third-party repair costs where ASLmods was not provided a reasonable opportunity to investigate or remedy the issue.

This does not apply where obtaining prior approval was unreasonable or impracticable, or where the Customer otherwise has a right to recover those costs under the Australian Consumer Law.


28. No Fault Found

If ASLmods or the relevant manufacturer reasonably determines that:

  • no defect exists;
  • the Goods operate within applicable specifications; or
  • the failure was caused by something excluded from ASLmods' voluntary warranty,

the voluntary warranty claim may be declined.

Where disclosed before assessment, ASLmods may recover reasonable:

  • testing;
  • assessment; and
  • freight costs

where no covered defect is found.


29. Assessment Timeframe

ASLmods will endeavour to assess a properly submitted warranty claim and provide an initial response within 14 business days after receiving sufficient information and, where required, the Goods.

Some claims may require additional time where assessment involves:

  • a manufacturer;
  • supplier;
  • engineering assessment;
  • specialist testing;
  • interstate freight;
  • technical analysis; or
  • other circumstances reasonably outside ASLmods' direct control.

ASLmods will keep the Customer reasonably informed of material delays.


30. Purchases Through Another Distributor or Reseller

Where Goods were purchased from an independent distributor, reseller or retailer rather than directly from ASLmods, the Customer should ordinarily contact the seller in the first instance.

The seller remains responsible for its own obligations under the Australian Consumer Law.

ASLmods may assist the seller or Customer with assessment of an ASLmods-manufactured product where appropriate.


31. Warranty Is Additional to Consumer Rights

The ASLmods Product Warranty is a voluntary warranty against defects.

It does not replace, restrict or limit the Australian Consumer Law.

The expiry of the stated ASLmods Warranty Period does not automatically mean that a Customer has no further rights.

Any additional rights will depend on the nature of the Goods and the circumstances of the particular claim.


32. Electronic Warranty Communications

Warranty claims and related communications may occur through:

  • email;
  • telephone;
  • SMS;
  • electronic messaging;
  • online forms; or
  • another communication method accepted by ASLmods.

ASLmods may rely upon electronic communications and business records as evidence of:

  • a warranty claim;
  • information supplied by the Customer;
  • return approval;
  • Customer instructions;
  • warranty assessment; or
  • agreed warranty arrangements,

to the extent permitted by law.


33. Changes to this Policy

ASLmods may update this Online Product Warranty Policy from time to time.

Unless otherwise required by law, the voluntary warranty terms applicable to Goods will generally be those provided or applicable when the Goods were purchased.

An amendment will not retrospectively remove rights already acquired by a Customer.

The current version of this Policy will be made available through the ASLmods website.
